These Terms & Conditions (“Terms”) govern your use of the ClickCapital website and the finance broking and lender-matching services we provide. Please read them carefully.
By accessing our website, submitting an enquiry or using our services, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.
ClickCapital is an Australian finance and credit broker. We help businesses compare and access finance by introducing them to third-party lenders and funders on our panel. We are a credit broker, not a lender. We do not provide credit or finance ourselves, and we do not guarantee that any lender will approve your application or offer particular terms.
To use our services you must be at least 18 years of age, be authorised to act on behalf of the business you are enquiring about, and be located in Australia. The finance we help arrange is for business purposes only.
Our service is to understand your finance needs and match you with one or more lenders who may be able to assist. When you submit an enquiry, you authorise us to share your details with those lenders so they can contact you with a quote or offer. Any finance is provided directly by the lender, under a separate agreement between you and that lender. We do not control, and are not responsible for, a lender’s decisions, products, rates or conduct.
The information on our website and provided through our service is general information only. It does not take into account your objectives, financial situation or needs, and is not credit assistance, financial product advice or a recommendation to enter into any finance. You should consider whether any finance is appropriate for you and seek independent legal, financial or tax advice before making a decision.
Any indications, calculators, lender matches or quotes shown on our website are estimates only and are not an offer of finance. They are subject to each lender’s assessment, eligibility criteria, terms and approval, and may change. The matching process does not involve a credit check and has no impact on your credit score; a lender may conduct its own checks if you proceed.
ClickCapital is generally paid a commission or referral fee by the lender or funder when finance is settled following an introduction we make. This does not change the amount you pay the lender. We will disclose remuneration where required by law. You are not charged a fee for using our matching service unless we agree otherwise with you in writing.
You agree to provide accurate, complete and up-to-date information, and to promptly tell us if anything changes. You are responsible for the information you submit and for any decision you make about finance. Providing false or misleading information may affect your application and may be reported to lenders or authorities.
Our website and communications may contain links to third-party websites, lenders and tools (including bank-statement verification provided by illion). We do not control and are not responsible for the content, products, terms or privacy practices of those third parties. Your dealings with any lender or third party are solely between you and them.
All content on this website, including text, graphics, logos, mascots, images and design, is owned by or licensed to ClickCapital and is protected by intellectual property laws. You may not copy, reproduce, modify or distribute our content without our prior written permission.
You agree not to use our website or services for any unlawful purpose, to interfere with or disrupt the website, to attempt to gain unauthorised access to our systems, or to submit content that is false, misleading, infringing or harmful.
Our website and services are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we exclude all warranties not expressly set out in these Terms, and we are not liable for any indirect, incidental or consequential loss, or for loss arising from your reliance on information provided, a lender’s conduct, or matters outside our reasonable control. Nothing in these Terms excludes any rights or guarantees you have under the Australian Consumer Law that cannot lawfully be excluded.
Our handling of your personal information is described in our Privacy Policy, which forms part of these Terms.
These Terms are governed by the laws of the State of Victoria, Australia, and you submit to the non-exclusive jurisdiction of the courts of that State.
We may update these Terms from time to time. The current version will always be available on this page, with the “last updated” date shown above. Continued use of our website or services means you accept the updated Terms.
